[칼럼] 정부 개정 입법안, 예비 특례시 의견 반영 안돼

행정안전부(행안부)가 수원시 · 고양시 · 용인시 등 특례시 출범을 앞둔 예비 특례시에 대해 본청에 실·국을 한시적으로 1개 설치와 함께 구청장을 보좌하는 4·5급 담당관을 신설하는 등의 내용을 담은 개정안을 입법 예고했다.

 

행안부가 지난달 30일 이 같은 내용을 포함한 '지방자치단체의 행정기구와 정원 기준 등에 관한 규정' 에는 특례시가 지향하는 중점업무와 특례 사무를 발굴하고 운영 등을 할 수 있도록 본청 내 실·국을 한시적으로 1개를 설치하고 주민들이 행정 서비스의 질적 개선을 느낄 수 있도록 구청장을 보좌하는 4·5급 담당관을 신설한다는 게 개정안의 주요 골자다. 개정안은 내년 1월 10일까지며 규정 개정안 시행은 같은 해 3월이다.

 

행안부는 내년 1월 13일부터 시행되는 지방자치법 개정안에 맞춰 특례시 및 특별자치단체 등의 조직 탄력성과 자율성을 높이기 위한 제도 개선에 따른 취지라고 밝히고 있으나 특례시 업무 확대에 필요한 수준에는 크게 못 미치는 데다 정부의 입법 예고가 늦어져 해당 지자체의 실질적 체감은 내년 지방선거 이후 가능할 것으로 예상된다.  

 

수원시 등과 함께 특례시 출범이 예정된 창원시는 마산·창원·진해 통합 인센티브로 2013년부터 5개 구 구청장을 보조하는 4급 ‘대민기획관’을 운용함에 따라 이번 개정안의 적용을 받지 않는다.

 

지난 11월 박완수 국회의원(국민의힘, 경남 창원시의창구)이 대표 발의 한 특례시에 필요한 핵심사무를 담은 지방자치분권 및 지방행정 체제개편에 관한 특별법(지방분권법) 일부 개정 법률안을 국회에 제출했다. 예비 특례시 지역구 국회의원 12명이 참여한 이번 법률안의 주요 내용은 지방분권법 제41조에서 규정한 인구 100만 이상 대도시의 사무 특례에 기존 9건 외에 '대도시권 광역교통 관리에 관한 사무' 등 16건의 특례 사무 권한 등이다.

 

비슷한 시기에 예비 특례시인 용인시는 인구 규모가 비슷한 울산광역시와 행정계층이 유사한 제주특별자치도의 조직 및 사무체계를 비교·분석해 자치구와 행정구(자치구가 아닌 구)간 제도적 측면의 문제점을 규명하고 개선점을 도출하면서 인구 100만 이상의 시는 2개의 실·국을 신설해 구청장의 과중한 업무를 경감하고 중간관리자를 통해 행정오류를 예방하는 등 특례시 맞춤형 행정서비스를 제공해야 한다고 제안했으니 이번 개정안에 제대로 반영되지 않았다.
